SUBJECT: New Hampshire House Bill 437

To all naturists:

This coming Wednesday, February 14, 2001, the Criminal Justice & Public Safety Committee of the New Hampshire House of Representatives will be considering a proposed new state law that could catastrophically affect the sale and distribution of family oriented naturist publications and other material in the state. House Bill 437, introduced by freshman state legislator Daniel Itse (R-Fremont), provides that "any person engaged in the sale, publication, or distribution of a visual representation of an unclothed child which exposes such child's genitals, shall be guilty of felony child pornography." The chilling effect onnudist and naturist publications is obvious.

The bill's sponsors have apparently chosen to ignore the recent decision by the U.S. Third Circuit Court of Appeals in which the court declared that naturist publications are a "protected tool for political change." In that decision the court ruled that depictions of mere nudity are not obscene and that images of nude children involved in benign naturist activities are not child pornography.*

The Naturist Action Committee urges New Hampshire naturists to attend the legislative committee hearing on Wednesday and speak against passage of this dangerous bill. The hearing is scheduled for 11 a.m. in room 204 of the Legislative Office Building at the State Capitol complex in Concord.

NAC also encourages naturists to call or write to members of the Criminal Justice & Public Safety Committee. This issue carries an enormous potential impact for all naturists, whether or not they are New Hampshire residents, so in this case, NAC urges ALL naturists to call or write, regardless of where they live.
