The "obscenity and public indecency" laws for the State of South Dakota underwent a significant revision in 2006 and again in 2009. In 2009, South Dakota adopted a law criminalizing "private indecent exposure." At the present time, a misdemeanor conviction for public indecent exposure can result in the requirement for registration on the state's sex offender list.


The South Dakota legislature meets from January 12, 2010, through March 29, 2010. Bills from 2009 DO NOT CARRY OVER to the 2010 session. Bills may be prefiled.
